In NYC, it is part of the officers job to show up at traffic court. They have to testify first and then if the judge deem their testimony acceptable, then you will have the opportunity to explain what happened for you to fight your traffic ticket. The officer has to state what happened and has to be very specific as to stating the type of violation that is being questioned. So everyone who gives advice online says to be polite, respectful, and to ask for a break. And that is all true. Here is a great tip on fighting a cell phone traffic ticket. In New York you can not use a cell phone while operating a vehicle. The law states that you can use a cell phone to make an emergency call while operating a vehicle. If you can convince an officer or judge, that you were on an emergency call, then you might just avoid getting the traffic ticket or getting it dismissed.
